BLUEKURTIC END USER LICENSE AGREEMENT & TERMS OF USE

Effective Date: 18 May 2026

This End User License Agreement (“EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Bluekurtic LLC (“Bluekurtic,” “we,” “our,” or “us”) governing your use of the Bluekurtic mobile application, website, and related services (collectively, the “Application”).

By downloading, accessing, or using the Application, you agree to be bound by this EULA.

1. Acknowledgement

This EULA is concluded solely between you and Bluekurtic LLC, and not with Apple Inc. (“Apple”).

Bluekurtic, and not Apple, is solely responsible for the Application and its content.

This EULA does not supersede or conflict with the Apple Media Services Terms and Conditions, and you acknowledge that you have had the opportunity to review those terms.

2. Scope of License

Subject to your compliance with this EULA, Bluekurtic grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on Apple-branded devices that you own or control and as permitted by the Apple Media Services Terms and Conditions.

The Application may also be accessed through Family Sharing or volume purchasing arrangements where permitted by Apple.

No ownership rights are transferred to you.

3. Nature of Services (Strict Non-Advisory)

Bluekurtic provides market research, financial analysis, statistical studies, educational content, and analytical tools solely for informational and educational purposes.

Bluekurtic does not:

·      Provide investment advice

·      Provide financial advice

·      Provide tax advice

·      Provide legal advice

·      Recommend the purchase or sale of securities

·      Act as an investment adviser, broker-dealer, or fiduciary

No fiduciary relationship is created between Bluekurtic and any user.

All investment decisions remain solely the responsibility of the user.

4. Risk Disclaimer

Investing involves substantial risk.

You acknowledge that:

·      Past performance does not guarantee future results

·      Markets can be volatile and unpredictable

·      Investments may lose value

·      You may lose part or all of your invested capital

You assume full responsibility for any financial decisions made based upon information obtained from the Application.

5. Research, Analysis & Backtesting Disclaimer

All content published by Bluekurtic:

·      Reflects our opinions and analysis

·      Is based upon internal models, research methodologies, and publicly available information

·      May contain errors, omissions, inaccuracies, or outdated information

Historical studies, backtests, simulations, and statistical analyses:

·      Are hypothetical in nature

·      Do not represent actual trading results

·      May not account for liquidity constraints, transaction costs, taxes, slippage, market impact, or behavioral factors

·      Are not indicative of future performance

Users should not rely exclusively on any content within the Application when making financial decisions.

6. Data Accuracy Disclaimer

Bluekurtic does not warrant the accuracy, completeness, reliability, timeliness, or availability of any information or data provided through the Application.

Market data may contain delays, interruptions, inaccuracies, or omissions.

Third-party data providers may introduce errors beyond our control.

7. Subscriptions, Billing & Payments

Bluekurtic may offer the following subscription plans:

·      Basic (Free)

·      Premium

·      Premium Plus

Subscription pricing may be displayed within the Application and may change from time to time.

For subscriptions purchased through Apple’s App Store:

·      Payment will be charged to your Apple ID account upon confirmation of purchase

·      Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

·      Your account will be charged for renewal within 24 hours prior to the end of the current subscription period

·      You may manage or cancel subscriptions through your Apple Account settings

Any free trial period offered by Bluekurtic will automatically convert into a paid subscription unless cancelled before the trial expires.

Except where required by applicable law, all purchases are final and non-refundable.

8. Account Usage

You agree that:

·      Your account is for individual use only

·      Account sharing is prohibited

·      You will maintain the confidentiality of your login credentials

·      You are responsible for all activity occurring under your account

Bluekurtic may suspend or terminate accounts for misuse, abuse, fraud, or violations of this EULA.

9. Intellectual Property Rights

All content available through the Application, including but not limited to:

·      Research reports

·      Charts

·      Graphics

·      Videos

·      Podcasts

·      Dashboards

·      Models

·      Indicators

·      Written commentary

·      Software code

are owned by or licensed to Bluekurtic LLC and are protected by intellectual property laws.

You may not:

·      Reproduce

·      Distribute

·      Publish

·      Sell

·      Modify

·      Commercially exploit

any content without prior written consent.

Unauthorized use may result in account termination and legal action.

10. Content Usage

All content is licensed solely for personal, non-commercial use.

Redistribution, republication, resale, or sharing of content without written permission is prohibited.

11. Maintenance & Support

Bluekurtic is solely responsible for providing maintenance and support services for the Application.

Apple has no obligation whatsoever to provide maintenance or support services for the Application.

12. Warranty Disclaimer

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEKURTIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

If the Application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the Application, if any.

To the maximum extent permitted by law, Apple shall have no other warranty obligation whatsoever regarding the Application.

13. Product Claims

Bluekurtic, and not Apple, is responsible for addressing any claims relating to the Application, including:

·      Product liability claims

·      Claims that the Application fails to conform to legal requirements

·      Consumer protection claims

·      Privacy claims

·      Regulatory claims

14. Intellectual Property Claims

If any third party claims that the Application infringes intellectual property rights, Bluekurtic, and not Apple, shall be solely responsible for investigating, defending, settling, and resolving such claims.

15. Limitation of Liability

To the fullest extent permitted by law, Bluekurtic LLC, its affiliates, officers, employees, contractors, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from:

·      Use of the Application

·      Reliance upon any content

·      Investment decisions

·      Loss of profits

·      Trading losses

·      Data loss

·      Service interruptions

Your sole remedy for dissatisfaction with the Application is to discontinue use.

16. Service Availability

Bluekurtic does not guarantee uninterrupted or error-free operation of the Application.

Features may be added, modified, suspended, or discontinued at any time without notice.

17. Legal Compliance

You represent and warrant that:

·      You are not located in a country subject to a U.S. Government embargo

·      You are not located in a country designated by the U.S. Government as a terrorist-supporting country

·      You are not listed on any U.S. Government prohibited or restricted parties list

18. Third-Party Services

You agree to comply with all applicable third-party agreements when using the Application, including agreements governing internet access, mobile networks, app stores, and payment services.

19. Termination

Bluekurtic may suspend or terminate your access at any time for violations of this EULA or for any other legitimate business reason.

Upon termination, all rights granted under this EULA immediately cease.

20. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.

21. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA.

Upon your acceptance of this EULA, Apple shall have the right to enforce this EULA against you as a third-party beneficiary.
